A Riverhead man is facing an assault charge after punching a Hess Mart clerk in the face when the clerk didn’t want to sell him cigarettes without ID yesterday morning, according to Riverhead Town Police.

Police said Justin T. Gray, age 26, became irate when a store clerk at the Hess Mart at 1879 Old Country Road refused to sell him cigarettes because he didn’t have identification showing proof of age.

Riverhead Police were called to the scene at about 7:35 a.m yesterday on the report of a disturbance at the Hess near Tanger Outlets.

The clerk suffered a laceration to his face that required treatment at Peconic Bay Medical Center, police said.

Gray was processed on a charge of assault in the third degree and held on $1,000 bail, police said.

Editor’s note: A criminal charge is an accusation. By law, a person charged with a crime is presumed innocent until proven guilty in a court of law.
